“We the undersigned petition the Prime Minister to force OFCOM to Comply with its obligations in ensuring a competitive Telecommunications Market for Hull by forcing Kingston Communications to publish full LLU pricing.”

“Ofcom has constistantly failed in its terms of reference and obligations in ensuring that the conditions for competition in the provision of electronic communication services exist within the Kingston upon Hull 01482 dialling code area under section 3b of the Telecommunications Act of 2003 detailed as “Ofcoms statutory obligations” This petition is force Ofcom into complying with its obligations and as Ofcom did with BT, force Kingston Communications (KCOM) to publish full Local Loop (LLU) pricing so that other Operators (OLO’s) can then make their own commercially based decision whether or not to enter the market. Should Ofcom fail to act, we the undersigned, call for the abolition of Ofcom as the regulatory body overseeing the UK telecommunications market.”

The Office of Communications (Ofcom), the independent regulator which is responsible for competition in the UK communications market, has put in place regulatory rules which allow other providers to offer communications services in the Hull area. However, the regulator cannot require other service providers to offer their services to the consumers of Hull.
In line with the European framework under which Ofcom regulates communications markets, Ofcom reviewed the UK markets for basic telephony and dial-up internet services in November 2003, and in May 2004 broadband markets were reviewed. In both cases Kingston Communications was found to have a Significant Market Share (SMP) for their catchment area.
Ofcom responded to these findings by imposing a number of stipulations on the company and they are now required to meet all reasonable requests by service providers for access to its network and to do so on fair and reasonable terms.
Ofcom remains fully prepared to investigate any accusation by a service provider that Kingston Communications is putting up unfair barriers to entry in the Hull market. It will use the full extent of its regulatory powers to ensure the integrity of competition and compliance with current legislation.
